By accessing or using the website at siouxcityconcretecontractor.com (the "Site") or by hiring Sioux City Concreteto perform services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Site or engage our services.
These Terms apply to all visitors, customers, and anyone who contacts us through the Site or by phone. We may update these Terms from time to time. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
Sioux City Concrete is a concrete contractor based in Sioux City, IA. We provide residential and commercial concrete services including, but not limited to, driveway installation, patio construction, foundation work, sidewalk building, stamped and decorative concrete, retaining walls, steps, and related concrete flatwork and structural services.
All services are subject to a written agreement between Sioux City Concrete and the customer prior to work beginning. The Site is for informational purposes and to facilitate contact with potential customers. It does not constitute a binding agreement for services.
Estimates provided by Sioux City Concrete are based on the scope of work described at the time of the estimate. All estimates are provided in writing and are valid for 30 days from the date issued, unless otherwise stated.
An estimate is not a guaranteed final price. Changes to the scope of work - including unforeseen site conditions, customer-requested additions or modifications, or changes to material costs - may result in a revised price. Any material changes to the scope or price will be communicated to the customer in writing before additional work proceeds.
Prices are not final until a written contract or work order is signed by both parties. Verbal estimates or ballpark figures provided by phone or in preliminary conversations are not binding.
Work is scheduled based on availability and the order in which confirmed agreements are received. Scheduling is subject to weather conditions, permit approvals, and other factors outside our control. We will notify you of any changes to your scheduled start date as soon as reasonably possible.
Concrete work requires specific weather conditions. We reserve the right to delay or reschedule a pour if conditions - including temperature, precipitation, or forecast - would compromise the quality of the finished work. We will work with you to find an alternative date as quickly as possible.
If you need to cancel or reschedule a scheduled project, please notify us as soon as possible. Cancellations made after materials have been ordered or permits have been pulled may result in fees to cover those costs. Any such fees will be communicated to you before they are charged.
Payment terms are outlined in the written estimate or contract for each project. A deposit may be required before work begins. The remaining balance is typically due upon project completion unless otherwise agreed in writing.
Accepted payment methods will be specified in your project agreement. Invoices not paid within the agreed time frame may be subject to a late fee as stated in the contract. If collection action becomes necessary, the customer agrees to be responsible for reasonable collection costs, including attorney fees, to the extent permitted by Iowa law.
You are responsible for ensuring that the work area is accessible and clear of vehicles, equipment, and other obstacles before the scheduled start date. You are responsible for disclosing any known underground utilities, drainage issues, property line locations, or other conditions that may affect the work.
Failure to disclose known site conditions that affect the scope or cost of the work may result in additional charges. Sioux City Concrete is not responsible for damage to unmarked utilities or underground features not disclosed prior to work beginning.
You are responsible for obtaining any required homeowner association approvals prior to work beginning. We will obtain required city permits on your behalf, but HOA approvals are your responsibility.
Where a permit is required by the City of Sioux City or another applicable jurisdiction, Sioux City Concrete will obtain the permit on your behalf as part of the project. Permit fees are the responsibility of the customer and will be included in the estimate or billed separately.
Work will not begin until required permits are in hand. Delays in permit issuance by the relevant authority are outside our control and may affect your scheduled start date.
To the fullest extent permitted by law, Sioux City Concrete will not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Site or from the performance of our services - including lost profits, property damage beyond the scope of our work, or loss of use.
Our total liability for any claim related to a project will not exceed the amount paid by you for that specific project. This limitation applies regardless of the form of the claim, whether in contract, tort, or otherwise.
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be error-free or uninterrupted.
Sioux City Concrete stands behind its workmanship. If a defect arises from our installation - not from normal wear, environmental conditions, or misuse - we will return to evaluate the issue and make it right at no additional cost.
Concrete is a natural material subject to cracking, settling, and surface wear over time. Minor cracking, surface discoloration, and normal settling are not defects. Damage caused by tree roots, vehicle impact, improper use of de-icing chemicals, or conditions outside our control are not covered by our workmanship commitment.
Any workmanship concerns must be reported to us in writing within 12 months of project completion to be considered under this commitment. We do not offer implied warranties beyond what is described here.
If a dispute arises between you and Sioux City Concrete, we ask that you contact us first at contact@siouxcityconcretecontractor.com so that we have an opportunity to resolve the matter directly. Most concerns can be worked out through a direct conversation.
If we are unable to reach a resolution directly, both parties agree to attempt mediation before pursuing litigation. Mediation will take place in Sioux City, IA, using a mutually agreed-upon mediator. Mediation costs will be shared equally unless otherwise agreed.
If mediation does not resolve the dispute, either party may pursue legal action in the courts of competent jurisdiction in IA.
These Terms and any dispute arising from your use of the Site or our services are governed by the laws of the State of Iowa, without regard to its conflict of law provisions.
Any legal action must be filed in the state or federal courts located in Woodbury County, Iowa. You consent to the personal jurisdiction of those courts for this purpose.
All content on the Site - including text, images, logos, and design - is owned by or licensed to Sioux City Concrete and protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any Site content without our written permission.
We reserve the right to update these Terms at any time. When we do, we will post the updated Terms on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.
